Greetings from Digi Assets! You acknowledge and agree to be governed by these terms and conditions (the "Terms and Conditions") by accessing or using any services on or via Digi Assets. "You" refers to the Digi Assets User, and "we," "us," "our," and "Digi Assets" refer to the relevant Contracting Party as used in these terms and conditions.
Agreement to the Terms
You accept these Terms and Conditions (including the Privacy Policy and the Refund Policy) as well as any other operating guidelines, policies, and procedures that we may occasionally publish on the Site. All of these are incorporated by reference and may change at any time without prior notice to you. This agreement is expressed by your registration for and/or use of the Services in any way, including but not limited to browsing the Site.
Your use of such services is subject to any additional terms and conditions that we may from time to time specify; these terms and Conditions are incorporated into these Terms and Conditions by this reference. Certain of the conditions may be subject to other terms and conditions that we may specify.
All users of the Services, whether registered or not, including users who contribute information, content, and other materials or services, are subject to these terms and conditions.
Terms of Account
Either 14 years old or at least the majority age in the jurisdiction where you reside and use the Services to open an account must be your age. We are not obligated to provide help for any subsequent problems that may arise if someone knowingly conceals their identity while using our services.
You understand that your primary email address, which you supply when creating an account or as you update it from time to time, will be used by Digi Assets as your principal means of communication ("Primary Email Address"). Your Primary Email Address must be able to receive messages, and you must keep an eye on the address that you give us.
It is your responsibility to keep your password safe. If you don't keep your password and account secure, Digi Assets won't be responsible for any losses or damages.
Only Digi Assets Users are given technical help about the Services. Send inquiries to Digi Assets Support regarding the terms of service.
Without Digi Asset’s prior written consent, you undertake not to replicate, copy, sell, resell, or exploit any part of the service, use of the service, or access to the service. Furthermore, no third party may utilize or benefit from the Services; they are only provided for your use.
The login details for your account should never be shared, published, or posted. One of our staff members or associates may request that your account be deleted, or you may do it directly.
We promise no exclusivity, and we maintain the right to provide our services to your rivals.
We reserve the right to ask for proof in order to establish or validate Account ownership in the event of a disagreement about Account ownership.
Terms of Conduct
You agree to refrain from using the Services for any purpose that is against these Terms of Service as a condition of using them. You are in charge of all activities related to your Account and the Services (including, but not limited to, communications you have with other users and the gathering of data from them).
You agree not to copy, rent, lease, distribute, or in any way transfer any of the rights you get under this agreement, nor to alter, translate, or otherwise make derivative works of any portion of the Services (directly or indirectly). You agree to follow all local, state, federal, and international laws and rules that may be relevant.
In addition, we reserve the right to access, read, preserve, and disclose any information that we reasonably believe is required to:
- Comply with any applicable law, regulation, legal process, or governmental request;
- Enforce these terms of service, including looking into possible violations);
- Detect, prevent, or otherwise address technical, fraud, or security issues;
- Respond to user support requests; or
- Protect our rights, property, or safety.
You might be able to connect from the Services to other websites, services, or online resources, and those other websites, services, or resources might link back to the Services. You use the Internet at your own risk when you access third-party resources. You understand that we have no control over these other resources and that we are not liable or responsible for any part of these websites or resources, including their functions, content, accuracy, legality, or suitability. Any such link's presence does not indicate our support for it or any kind of affiliation between us and its operators. You additionally understand and accept that we won't be held accountable or liable, directly or indirectly, for any loss or damage resulting from, or claimed to result from, the use of, or reliance on, any such material, or services made available on or through any such resource.
Terms of Payments
The payment account associated with your Account on the Services (your "Billing Account") is how we charge you for using the Paid Services; this payment processor is a third party. Apart from these Terms of Service, the terms, conditions, and privacy policies of the Payment Processor will also apply to the processing of payments. We are not liable whether the payment processor makes a mistake.
If you choose to use Paid Services, you authorize us to charge your preferred payment provider (your "Payment Method") through the Payment Processor and agree to pay all charges at the then-current prices for any use of such Paid Services in compliance with the applicable payment terms. You consent to paying with the chosen payment method. Even after it has requested or received payment, we maintain the right to fix any errors or mistakes that it makes.
Agreements between you and the financial institution, credit card issuer, or other provider of your selected Payment Method may govern the terms of your payment, which will be depending on your Payment Method.
Warranty and other concerns
We owe you no special consideration or fiduciary obligation. You understand that we are under no obligation to act in any way with respect to:
- Which users are able to access the Services;
- The content that you view through the Services; or
- Your interpretation and application of the Content.
You absolve us of all responsibility over Content you may have obtained through the Services or may not have obtained. We disclaim all responsibility or liability for the accuracy, copyright compliance, or legality of any material or Content included in or accessed via the Services. We also make no warranties about any Content included in or accessed through the Services.
We cannot guarantee that there won't be any errors or interruptions when using the services. Specifically, maintenance, updates, or system or network failures may cause the services to stop operating, which could lead to errors or data loss. In the event that there is a malfunction or interruption, or if any data or information that you supply to Digi Assets is lost, we disclaim all liability for damages. Also, we disclaim all liability for any malfunctioning, impossibility of access, or poor use conditions of the services due to appropriate equipment, disturbances related to internet service providers, saturation of the internet network, and any other reason.
Liability Restrictions
If it cannot be demonstrated beyond a reasonable doubt that the loss or damage you experienced was caused by our goods, we shall not be held responsible. Under no circumstances will Selfish, its suppliers, service providers, officers, directors, employees, contractors, or agents be held liable for lost profits or any other type of special, indirect, punitive, incidental, or consequential damages arising out of or related to the Services or these terms, including negligence.
Alteration
By posting a notice on the Site or sending you notice through the Services, via email or by another suitable means of electronic communication, we reserve the right, at our sole discretion, to alter or replace any of these Terms of Service, or to change, suspend, or discontinue the Services (including, without limitation, the availability of any feature, database, or content). Furthermore, without prior warning or obligation, we have the right to limit specific features and services or to prevent you from using all or some of the Services. It is your duty to regularly review these Terms of Service for updates, even though we will promptly notify you of any adjustments. Any modifications to these Terms of Service that are communicated to you through the Services will be deemed accepted if you continue to use the Services after they are posted. The Terms of Service that are in force at the time of your usage of the Services apply to you.
Miscellaneous
When you successfully register to use a service, these terms and conditions will come into effect. They will stay in effect until you or we terminate them as specified below.
If the Services are terminated by either party for any reason, Digi Assets will stop offering the Services to you and you won't be able to access your Account. Unless the Terms and conditions specify otherwise, you won't be eligible for any pro rata or other refunds of the Fees.
